FLEXIBLE PARCEL INSURANCE PROTECTION FOR ORDER FULFILLMENT SHIPMENTS | Explanation of Program Coverage | 

 

1. SCOPE OF COVERAGE: The Insurance Policy provides coverage for physical loss and/or damage to merchandise contents of eligible shipment packages. Coverage under the Insurance Policy is subject to insuring conditions, limitations and exclusions. Note that the Insurance Policy provides no coverage for delay in transit or for consequential or indirect losses. The scope of coverage under the Insurance Policy is summarized as follows:

(a) Duration: Coverage under the Insurance Policy commences upon the shipping provider acquiring a physical scan of the package for small package shipment, as determined by the tracking information. Coverage continues in the course of transit until such time as delivery is made at the consigned destination or until 30 days after transit is terminated at any place, whichever is sooner. Delivery includes, but not limited to: delivery to the consignee or the consignee’s actual or apparent agent or representative; delivery to the address or location specified in the shipping system; delivery to a reasonable alternative address or location or Access Point; delivery in accordance with trade custom or usage; delivery pursuant to shipper's driver release procedures; or delivery otherwise permitted under the applicable delivery service providers' terms and conditions of service.

(b) Valuation: The customer must declare/report the invoice price, or their selling price if not the same as the amount invoiced to the consignee. As to used, second-hand, refurbished and/or rebuilt merchandise not sold, proper valuation shall be replacement cost at destination. Coverage will be limited in all events to the lowest of insured value declared/reported, the correct valuation, the actual covered losses incurred or the maximum coverage limit; the Insurance Policy is not an agreed value policy. As to used, second-hand, refurbished and/or rebuilt merchandise, coverage shall additionally not exceed the reasonable cost of repair without any compensation for diminution in value consequent to any repair.

(c) Excluded Commodities & Packages: The Insurance Policy excludes the following commodity and package types from coverage:

 fireworks;  money orders;  works of art;  coins, currency;  unset precious stones;  gambling devices where prohibited by law;  postage stamps;  industrial diamonds;  hazardous waste;  negotiable instruments (except checks);  lottery tickets;  live animals or insects;

The Insurance Policy also excludes from coverage: 

  1. any article which contains more than fifty percent by weight of gold or platinum or any combination thereof in raw form, including but not limited to, bullion, balls, bars, grains, strip, sheet, wire, chain, ingots and the scrap of these metals; 
  2. any package having a value greater than the maximum coverage limit applicable to the service level;
  3. human remains, bodily fluids, fetal remains, unless shipped to/from a recognized medical or scientific institution for scientific or medical purpose;
  4. face value of checks, phone cards, gift certificates, event tickets or gift cards;
  5. any commodity prohibited by the UPS tariff and any packages that exceed weight or size restrictions in the UPS tariff;
  6. packages containing materials requiring shipping papers or license which are presented for shipment at a UPS authorized shipping outlet;
  7. packages tendered to UPS Return Services requiring adult signature upon delivery pursuant to the UPS Tariff;

(d) Excluded Risks: As with all insurance, coverage under the Insurance Policy is subject to exclusions which exclusions specifically include loss or damage resulting from or attributable to:

  • insects, moths, vermin, inherent vice, deterioration, dampness of atmosphere, extreme of or changes in temperature, ordinary wear and tear, or that which occurred or arose prior to or after the course of transportation by the Designated Carrier;
  • improper, inadequate or unsafe packaging or wrapping that fails to the standards published in the Designated Carrier’s Tariff in effect at time of shipment;
  • seizure of goods, acts of terrorism, nuclear damage, acts of public authorities acting with actual or apparent authority, acts or omissions of customs officials, authority of law, the application of security regulations imposed by the government or otherwise applicable to the shipment, disruptions in air or ground transportation networks, disruption or failure of communication and/or information systems;
  • face value of checks, phone cards, gift certificates, event tickets or gift cards;
  • any commodity prohibited by the UPS tariff and any packages that exceed weight or size restrictions in the UPS tariff;
  • packages containing materials requiring shipping papers or license which are presented for shipment at a UPS authorized shipping outlet;
  • packages tendered to UPS Return Services requiring adult signature upon delivery pursuant to the UPS Tariff;
  • mechanical/electronic derangement, rust, oxidation, marring, scratching, chipping, cracking, denting or tearing of used or unsealed new merchandise;
  • improper packing and/or inadequate labeling;
  • shipments dispatched, re-routed, stopped in transit or retrieved at a point other than the original consigned delivery point as a result of fraud or trick upon the Assured, shipper and/or consignee to specifically include shipments dispatched as a result of, or upon the request of, an imposter
  • damages arising from delayed delivery;
  • damages to containers to include briefcases, luggage, and cases and containers of all types when not enclosed in outer package;
  • concealed damages discovered in packages not opened within 30 days of delivery or otherwise not discovered within 30 days from delivery;
  • failure of a consignee to pay for a Collect on Delivery (C.O.D.) shipment or release of a package by UPS to the intended consignee without collection of C.O.D. charges.
